A New Jersey Court decides against the Yasmin pill patent

A New Jersey court decided against the contraceptive Yasmin pill of Laboratorios Schering, acquired by Bayer in 2006, within a legal dispute with the generics producer Barr Laboratories.

'Bayer considers this decision mistaken and shall study new legal steps, as the company wants to vehemently defend his patent rights', said the German company in a communiqué.

Besides, Bayer studies the repercussion of this legal decision over the Yasmin patent over the oral contraceptive YAZ, which was approved by North American Sanitary authorities in 2006.

The Sentence of the New Jersey’s Court considers invalid the patent 531 for Yasmin.

However, Bayer has exclusivity to sell YAZ in the United States as oral contraceptive, until March 16, 2009.

That is why, according with the German company, the generic manufacturers cannot sell a generic version of YAZ as oral contraceptive, before that date.

Bayer Schering Pharma, with Yasmin, invoiced in the United Stated 321 million Euros (488 million dollars) in 2007.

At the Frankfort Stock Exchange, the Bayer shares were lowing down today at around 08.20 GMT in a 5,1 %, down to 47,63 euros after known the judicial decision against the German Company.
